Inside every problem lies an opportunity
Clenz.io’s Dispute Resolution Process:
Clenz.io strives to provide a platform for a smooth and positive experience for all its users. However, if disagreements arise, we have a dispute-resolution process in place to address them fairly and efficiently. This process is outlined in our Terms of Service, and it includes arbitration as the primary method for resolving disputes.
What is Arbitration?
Arbitration is a private, out-of-court process where a neutral arbitrator settles a dispute instead of a judge or jury. It is generally faster and less expensive than going to court. However, it is important to understand that by agreeing to our Terms of Service, you are giving up your right to sue Clenz.io in court and have a jury trial.
What types of disputes does arbitration cover?
Arbitration covers almost all disputes arising out of or relating to your use of the Clenz.io platform, including:
- Issues related to your access or use of the platform
- Disputes about the Services provided by Clenz.io
- Claims of personal injury or death allegedly caused by the platform
- Any other disagreements between you and Clenz.io
Exceptions to Arbitration:
There are a few limited exceptions to arbitration:
- You can bring individual claims in small claims court if they meet the court’s jurisdictional limits.
- You can pursue individual claims of sexual assault or sexual harassment in court.
- You can seek injunctive relief in court to prevent immediate harm caused by Clenz.io.
How does arbitration work?
If you have a dispute with Clenz.io and it cannot be resolved informally, you must initiate arbitration according to the process outlined in the Terms of Service. This involves:
- Submitting a written demand for arbitration to the other party and the arbitration provider.
- Engaging in a good-faith effort to resolve the dispute through informal discussions before proceeding with arbitration.
- Participating in the arbitration process, which may involve exchanging information, attending hearings, and presenting arguments.
- Accepting the arbitrator’s decision, which is final and binding on both parties.
Important things to know about arbitration:
- You and Clenz.io agree to waive your right to class action lawsuits and other collective legal proceedings.
- The arbitration will be conducted individually, meaning you cannot join your claim with others against Clenz.io.
- The arbitrator’s decision will be final and binding, with limited exceptions for appeal.
- You are responsible for your share of arbitration fees, as outlined in the arbitration provider’s rules.
